The Act applies to every employer with 10 or more employees — including temporary, contractual and work-from-home staff. Smaller employers have obligations under the Local Complaints Committee mechanism. If you have staff, the Act applies.
Yes, mandatory. Every Internal Complaints Committee must have at least one external member — a person not employed by the organisation who is either a committed social worker with five years of experience in gender issues, or a legal professional. Kanika Rao serves as external ICC member for organisations across India.
A first offence carries a monetary penalty of up to ₹50,000. Repeat offences can result in doubling of the penalty, cancellation of the business licence and criminal prosecution of the employer. The reputational exposure in a public complaint can be far more serious than the statutory penalty.
The Act requires regular awareness programmes but does not specify a frequency. Best practice — and what most regulators expect to see — is annual awareness training for all employees and role-specific training for ICC members and managers. Many organisations also train new joiners during induction.
Yes. Online training — live webinars, recorded e-learning modules and hybrid sessions — is entirely valid for compliance purposes. The format should be documented, completion should be tracked, and the content must meet the awareness requirements of the Act.
The ICC must investigate a complaint within 90 days, give the respondent an opportunity to respond, record statements, examine documents and witnesses, and submit a report with recommendations to the employer. The process has procedural requirements set out in the Act and clarified by courts. Getting it wrong exposes the employer to challenge.
